The Lifecycle of a Civil Lawsuit

Civil litigation involves a legal dispute between two or more parties seeking monetary damages or specific performance, rather than criminal sanctions. 1. Pleadings: Initiating the Lawsuit

The process begins when the Plaintiff files a Complaint in the appropriate court, outlining the allegations and the relief sought. The Defendant is formally served with this Complaint and must file an Answer within a specific timeframe (usually 30 days in Circuit Court). The Answer addresses the allegations and asserts any affirmative defenses or counterclaims.

2. The Discovery Phase

Discovery is the longest and most critical phase of litigation. Both parties exchange information and gather evidence to build their cases. Common discovery tools include:

  • Interrogatories: Written questions that must be answered under oath.
  • Requests for Production: Demands for documents, emails, records, and physical evidence.
  • Depositions: In-person questioning of parties and witnesses under oath, recorded by a court reporter.

3. Pre-Trial Motions and Settlement

Before trial, attorneys may file motions, such as a Motion for Summary Judgment, asking the judge to rule on the case based on the undisputed facts discovered, avoiding a trial entirely.

The vast majority of civil cases never reach a jury. Through negotiation or formal mediation, parties often reach a settlement agreement. A settlement provides certainty and avoids the immense cost and unpredictability of a trial.

4. Trial

If no settlement is reached, the case proceeds to trial before a judge or a jury. Both sides present opening statements, call witnesses, introduce evidence, and make closing arguments. The jury (or judge) then renders a verdict.
